I can certainly say that I have been maliciously persecuted for maintaining science is right. On this forum latest of all.

Mann has a legitimate interest in a spotless record. He can show damages of unprecedented scope in this case, and the agencies that were lied to and investigated him are prepared to testify in his favor in exchange for not being named.

Mann's attorneys are going to very slowly roll you over the hot coals. When they're done you're going to admit you knew you were wrong, you intended to punish Mann for it, and you lied to try to accomplish it, and surrender any scientific credentials you have.

Malicious means that they persisted out of spite even after they knew they were wrong. The judge will almost certainly require them to say this aloud in public and apologize for it, and will punish them for contempt of court if they don't. They're not attacking a public figure this time, but a private scientist. And falsely, and with malice.
Furthermore, it seems to me that someone making a false complaint that causes a federal investigation which finds not only that the accused is innocent but that the complaint was malicious, is likely to be found guilty of perjury, conspiracy to commit perjury, and a number of fairly unpleasant other crimes that the various agencies charge people who make false accusations with. And these are criminal, not civil, complaints. Like, not just money but lets-just-be-friends time with Bubba.
